OUR FEES

REAL ESTATE

 

PURCHASE                                                                                     $1299.00 


Includes all legal fees, internal office expenses, title searches on a standard transaction related to a a single-family residential property for up to 1.8M; review of Status Certificate (Condominiums), with a mortgage from one of the big six banks of Canada. Fees may increase if unforeseen title/off-title complications arise, among others: closing extensions, split signing appointments, non-residents of Canada, expired restrictions, etc.

If applicable, all the following are extra:


• $299 if mortgage instructions are received from a financial institution other than the ones mentioned above and including TD Canada Trust Broker Channel.


• $299 if mortgage instructions are received/revised or there is a lender change within 3 banking days of closing date.


• A fee of $599 on properties over 1.8 M.


• Title search on extra pins on those properties that are not a whole of a lot, such as part of a lot properties on which adjoining lands are to be searched or condominiums with more than the dwelling unit.


• Province of Ontario and City of Toronto Government Land Transfer Tax, which will depend on the purchase price and whether the client is considered first time or not.


• City of Toronto Municipal Land Transfer Tax administration fee of $82.86.


• Government registration fees ($78.79 for each instrument, usually transfer and mortgage).


• Sheriff’s Certificates, which will reveal if there are any judgments registered against you or the vendors. Currently the cost is $12.15 in the City of Toronto and $15.88 outside City of Toronto per person.


• Title Insurance, which will depend on the purchase price and the mortgage amount to be registered.


• Non-Resident Speculation Tax (15% on the purchase or acquisition of an interest in residential property).


• Property tax and/or utilities certificates from the municipality where the property is located.


• Government taxes.


• Banking fees.

SALE                                                                                     $899.00  


Includes all legal fees, internal office expenses, on a standard transaction related to a single-family residential property for up to 1.8M, with only one mortgage to be discharged.


If applicable, all the following are extra:


• $599 on properties over 1.8 M.


• $499 on any other transaction related issue not limited to:


  • Bridge financing and related disbursements. 
  • Paying out other secured and/or unsecured debts or discharging a second or private mortgage. 
  • Tenants are to be assumed by the purchaser/s.
  • Closing extensions, split signing appointments, deletion of unknown liens or expired restrictions.
  • Discharging a NOSI.


• Government taxes.


• Banking fees.


• LSO transaction levy surcharge.

MORTGAGE / REFINANCING                                                                       $799.00 


Includes all legal fees on a standard transaction related to a single-family residential property from one of the big six banks of Canada.


All the following are extra, if applicable:


• $299 if mortgage instructions are received from a financial institution other than the ones mentioned above and including TD Canada Trust Broker Channel.


• $499 on circumstances not limited to:


  • Paying out other secured and/or unsecured debts or discharging a second or private mortgage.
  • Postponing or discharging a NOSI.
  • Split signing appointments; deletion of liens or expired restrictions.


• Office disbursements and expenses, such as Couriers; title search; photocopying, printing, downloading and scanning, etc.


• Government registration fees of ($78.79 per instrument.


• Sheriff's Certificates at the cost of $12.15 in the City of Toronto and $15.88 outside City of Toronto per person.


• Title Insurance which depends on the mortgage amount to be registered.


• Government taxes.


• Banking fees.

TRANSFER OF TITLE / SURVIVORSHIP APPLICATION

$699.00 


All the following are extra:



  • Government registration fees of $$78.79 per instrument; 
  • Sheriff’s Certificates at the cost of $12.15 in the City of Toronto and $15.88 outside the City of Toronto per person; 
  • Title Insurance; if applicable.
  • Office disbursements and expenses, such as Couriers; title search; Photocopying, printing, downloading and scanning, etc.
  • Government taxes.
  • Banking fees.

ADDITIONAL MATTERS OR ISSUES FOR WHICH CUSTOM OR HOURLY FEES SHALL APPLY:

 

  • Division of property and disposition of sale proceeds among sellers or spouses, split signing appointments, sale or purchase by non-residents of Canada


  •  Negotiating and drafting the agreement of purchase and sale either on a resale or new property transaction.


  •  Interim Closing of a new condominium unit, on which additional fees of $499.00 plus HST and related disbursements are to be added. The fees are payable at the time of the interim occupancy date.


  • Registration of Assignments of leases and rents and PPSA’s.


  •  Removal of executions and applications to clear title either on a purchase, sale or refinancing transaction.


  • Additional mortgage to be registered on closing.


  • Acting for a non-resident.


  • Private mortgages; purchases or sales of vacant land, multiple units, cottages and commercial properties.


  • Unforeseen issues and/or difficulties which render the transaction not to be standard.

Notes:

  • A will includes both a Continuing Power of Attorney and for property and a Power of Attorney for personal care.

  • In a Simple Will, except for specific bequests, your entire estate will either go to your spouse, or to your children, if your spouse dies before you. If you have a large amount of assets, own a private corporation, or want to do more complicated things, you would need to contact the office for a custom quote.

ESTATES

 

Application for the Certificate of Appointment of Estate Trustee With a Will or Without a Will

  • Fees are custom made based on the value of the estate, the responsibility and professional skills required, the difficulty, novelty of the issues and the time involved.
  • Usually the application for a certificate of appointment of an estate trustee, involves reviewing and advising on the deceased's assets and liabilities, the entitlement of creditors, the beneficiaries and heirs, the terms of the will or, if there is no Will, the distribution on intestacy, the duties and rights of the estate trustee; preparing the application for certificate of appointment of estate trustee; preparing documents to transfer assets of the deceased to the estate trustee; advising as to and preparing documents to distribute assets in specie to beneficiaries and to obtain releases of the estate trustee and reporting to the estate trustee in connection with these matters.
  • Estate is also responsible for paying filing applications and estate fees, administration bonds (if required), courier expenses and software transaction charges.
  • Additional matters such as advice about transfer of assets are not included.

  • Some matters require payment of retainer before commencing work on your behalf.
