Notes:

  • A will includes both a Continuing Power of Attorney and for property and a Power of Attorney for personal care.

  • In a Simple Will, except for specific bequests, your entire estate will either go to your spouse, or to your children, if your spouse dies before you. If you have a large amount of assets, own a private corporation, or want to do more complicated things, you will need to contact the office for a custom quote.

ESTATES

APPLICATION FOR THE CERTIFICATE OF APPOINTMENT OF ESTATE TRUSTEE WITH A WILL OR WITHOUT A WILL

  • Fees are custom made based on the value of the estate, the responsibility and professional skills required, the difficulty, novelty of the issues and the time involved.

  • Usually the application for a certificate of appointment of an estate trustee, involves reviewing and advising on the deceased's assets and liabilities, the entitlement of creditors, the beneficiaries and heirs, the terms of the will or, if there is no Will, the distribution on intestacy, the duties and rights of the estate trustee; preparing the application for certificate of appointment of estate trustee; preparing documents to transfer assets of the deceased to the estate trustee; advising as to and preparing documents to distribute assets in specie to beneficiaries and to obtain releases of the estate trustee and reporting to the estate trustee in connection with these matters.

  • Estate is also responsible for paying filing applications and estate fees, administration bonds (if required), courier expenses and software transaction charges.

  • Additional matters such as advice about income taxes and transfer of assets are not included.
